TexturePass LLC ("TexturePass," "we," "us," or "our") respects your privacy. This Privacy Policy explains what personal information we collect, how we use and share it, and the choices available to you when you visit texturepass.com (the "Site") or purchase from us.
1. Information We Collect
Information you provide directly
- Contact information: name, email address, shipping address, billing address, and phone number if you provide one
- Order information: products purchased, order value, order history, and membership status
- Account information: login credentials and saved preferences
- Payment information: processed by our payment processor. TexturePass does not collect or store full payment card numbers on its own systems
- Communications: the content of emails, support requests, product reviews, and survey or newsletter signup responses
- Marketing signups: email address (and phone number, if provided) submitted through pop-ups, footer forms, or other signup prompts on the Site
Information collected automatically
- Device and browser information, including IP address, browser type, operating system, and device identifiers
- Usage information, including pages viewed, links clicked, referring pages, items added to cart, and time spent on the Site
- Cookies, pixels, and similar tracking technologies as described in Section 5
We do not currently collect hair type, porosity, scalp condition, or similar assessment data. If we introduce a hair quiz or similar feature in the future, we will update this Policy before doing so.
2. How We Use Your Information
- To process, fulfill, and ship your orders and send order confirmations and shipping notifications
- To create and manage your account and administer your membership, including billing, renewal notices, and cancellation requests
- To provide customer support and respond to your inquiries
- To send marketing emails about products, promotions, and new brand additions, where you have opted in
- To personalize your experience and show you relevant products and offers
- To measure and improve the performance of the Site and our advertising
- To detect, investigate, and prevent fraud, abuse of promotions, and other unlawful activity
- To comply with legal obligations, including tax, accounting, and consumer protection requirements
3. How We Share Your Information
We do not sell your personal information for money. We share personal information in the following circumstances:
Service providers
We share information with vendors who perform services on our behalf and are contractually limited to using it for those services:
- E-commerce platform and payment processing — to operate the Site, host our store, and process transactions
- Subscription management — to administer membership billing, renewals, and cancellations
- Email and SMS marketing platform — to send transactional and marketing communications
- Order fulfillment and shipping, our third-party logistics provider, shipping-protection/returns provider, and shipping carriers receive your name, shipping address, and order contents in order to pick, pack, deliver, and manage returns or claims on your order
Advertising partners
We use advertising and analytics tools from third-party platforms, including the Meta advertising pixel, to measure the effectiveness of our advertising and to show you relevant ads on other platforms. Sharing information with these partners for targeted advertising may be considered a "sale" or "sharing" of personal information under certain state privacy laws, even though no money is exchanged. You can opt out as described in Section 6.
Legal and business transfers
We may disclose information where required by law, subpoena, or legal process; to protect our rights, property, or safety or that of others; to enforce our Terms of Service; or in connection with a merger, acquisition, financing, or sale of all or part of our business.
4. Retention
We retain personal information for as long as needed to provide our services and for legitimate business purposes, including maintaining order and transaction records for tax and accounting purposes, resolving disputes, and enforcing our agreements. Order and membership billing records are generally retained for at least seven years to meet tax and recordkeeping obligations. Marketing contact information is retained until you unsubscribe or request deletion.
5. Cookies and Tracking Technologies
We and our partners use cookies, pixels, and similar technologies to operate the Site, remember your cart and preferences, understand how the Site is used, and deliver and measure advertising.
- Strictly necessary cookies enable core functions such as your shopping cart, checkout, and account login. The Site cannot function properly without these.
- Analytics and performance cookies help us understand how visitors use the Site.
- Advertising and targeting cookies, including the Meta pixel, help us and our partners deliver and measure ads.
You can manage cookie preferences through the cookie banner on the Site and through your browser settings. Blocking some cookies may affect Site functionality. We honor Global Privacy Control (GPC) browser signals as an opt-out of the sale or sharing of personal information where required by law.
6. Your Privacy Choices and Rights
Marketing communications
You can unsubscribe from marketing emails at any time using the link in any marketing message or by emailing hello@texturepass.com. You will continue to receive transactional messages relating to your orders and membership, including renewal notices required by law.
Targeted advertising opt-out
To opt out of the sharing of your personal information for targeted advertising, use the cookie preferences control on the Site, enable a Global Privacy Control signal in your browser, or email us at hello@texturepass.com with the subject line "Opt Out of Targeted Advertising."
State privacy rights
Depending on your state of residence, you may have the right to request access to the personal information we hold about you; to request correction of inaccurate information; to request deletion of your information; to obtain a portable copy of your information; and to opt out of the sale or sharing of personal information for targeted advertising. We will not discriminate against you for exercising these rights.
To make a request, email hello@texturepass.com with the subject line "Privacy Request." We will verify your identity by confirming information associated with your account or recent orders, and will respond within the timeframe required by applicable law. An authorized agent may submit a request on your behalf with written proof of authorization.
If we deny your request, you may appeal by replying to our response with the subject line "Privacy Appeal."
7. Security
We use commercially reasonable administrative, technical, and physical safeguards to protect personal information, and we rely on our e-commerce and payment platforms to maintain payment card industry security standards for transaction data. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
8. Children
The Site is intended for individuals 18 years of age and older. We do not knowingly collect personal information from anyone under 18. If we learn that we have collected information from a person under 18, we will delete it. If you believe a minor has provided us information, contact hello@texturepass.com.
9. Where We Operate
TexturePass is based in the United States. A membership can be purchased by customers throughout the United States and its territories, but we currently ship physical products only to addresses in the contiguous United States and Washington, DC. We store and process information primarily in the United States; however, some of the service providers described in Section 3 may process or store information outside the United States in connection with the services they provide to us.
10. Changes to This Policy
We may update this Privacy Policy from time to time. The "Last updated" date reflects the most recent revision. If we make material changes to how we use your personal information, we will provide notice on the Site and, where required, by email.
